General Terms and Conditions
Article 1 – Definitions
In these General Terms and Conditions, the following definitions apply:
Withdrawal period: the period within which the consumer may exercise the right of withdrawal.
Consumer: a natural person who is not acting in the course of a business or profession and enters into a distance contract with AquaCase.
Day: a calendar day.
Long-term contract: a distance contract relating to a series of products and/or services, where the delivery and/or purchase obligation is spread over time.
Durable medium: any means that enables the consumer or AquaCase to store information addressed to them in a way that allows future reference and unchanged reproduction.
Right of withdrawal: the consumer’s right to withdraw from a distance contract within the withdrawal period.
AquaCase: the legal entity offering products and/or services remotely to consumers.
Distance contract: a contract concluded within an organized system for distance selling, using one or more means of remote communication up to and including the conclusion of the contract.

Article 3 – Applicability
These General Terms and Conditions apply to every offer from AquaCase and to every distance contract concluded between AquaCase and the consumer.
Before the distance contract is concluded, the consumer receives a copy of these Terms and Conditions. If this is not reasonably possible, AquaCase will indicate where the terms can be accessed and that they will be provided free of charge upon request.
Article 4 – Offer
If an offer has a limited validity period or is subject to specific conditions, this will be clearly stated.
All offers are non-binding. AquaCase reserves the right to change or adjust offers at any time.
The offer includes a complete and accurate description of the products and/or services offered.
Article 5 – Contract
The contract is concluded when the consumer accepts the offer and fulfills the stated conditions.
When the consumer accepts electronically, AquaCase will promptly confirm receipt of the order electronically.
AquaCase reserves the right to verify the consumer’s payment ability and to reject orders in justified cases.
Article 6 – Right of Withdrawal
The consumer has the right to withdraw from the contract within 90 days of receiving the product.
The withdrawal must be requested via the contact form during this period.
After notification, the consumer has an additional 14 days to return the product once instructions are provided by AquaCase.
Article 7 – Return Costs and Process
If the right of withdrawal is exercised, the consumer bears the cost of return shipping (€8–€12).
Returns must always include Track & Trace, as AquaCase is not responsible for lost parcels.
In case of damaged products, the consumer must provide photos or videos within 48 hours. Upon confirmation, a replacement or refund will be offered.
If the return is due to dissatisfaction, AquaCase will first attempt to provide an appropriate solution.
To initiate any return or refund request, please contact us through the contact form. AquaCase will provide all necessary return instructions directly to the customer.
Refunds are processed within 14 business days after the returned goods have been received and inspected.
Article 8 – Exceptions to the Right of Withdrawal
The right of withdrawal does not apply to:

Custom-made products
-
Perishable goods
-
Hygiene-sensitive products once opened
Article 9 – Prices
Prices remain unchanged during the validity period of the offer, except for VAT adjustments or similar statutory changes.
Article 10 – Warranty and Complaints
Products must comply with the agreement, the stated specifications, and reasonable usability.
Defects must be reported within 14 days of receipt.
Complaints must be submitted within 7 days of discovery and will be handled within 14 days.
Article 11 – Delivery and Fulfillment
AquaCase processes orders with the utmost care.
Delivery takes place at the address provided by the consumer.
Average delivery time is 6–12 business days.
In the event of delays, the consumer will be informed within 30 days and may cancel the contract if desired.
Article 12 – Payment
Payment must be completed within 7 business days, unless otherwise agreed.
Article 13 – Disputes
Contracts between AquaCase and the consumer are governed exclusively by Dutch law, even if the consumer resides abroad.
